Wells Fargo agrees to pay nearly $50 million to settle class action lawsuit

Senior Premier Bankers to receive on average $7,137 in unpaid overtime wages

On November 30, 2023, Senior Premier Banker Sabrina Perez, who led the successful organizing at the Eldorado Branch in Albuquerque, New Mexico which became the first union branch in the country, filed a complaint against Wells Fargo alleging Wells Fargo improperly classified its Senior Premier Bankers as overtime exempt, denying them proper overtime pay in violation of the Fair Labor Standards Act.

Last week, Wells Fargo agreed to settle these claims for $48.5 million. Senior Premier Bankers employed during at least the past three years are eligible members of the class. Members of the class stand to recover an average net award of $7,137 each.

In response to this settlement, Wells Fargo has voluntarily changed the employment status for all senior premier bankers (SPB), converting all current SPB's to hourly, non-exempt, meaning SPB's will now be paid overtime.

Senior Premier Bankers at union branches have additional rights. We are formulating our response to these changes and we would like to hear from you.
